GUESTS AGREE:

  1. That they have been provided with the Park rules and that they agree to abide by the rules as currently in effect and as may be later modified by the Board or by the members of DPRB.
  2. That Guests may use the Park only for dogs listed on the Guest Application that have current rabies immunization records on file and that have been approved by DPRB.
  3. That the Board of DPRB may limit, suspend or terminate the privileges to use the Park for any reason and without hearing.
  4. That they understand that they may utilize the Dog Park for their dogs only while accompanied by a member of DPRB.

ASSUMPTION OF RISK, RELEASE, WAIVER AND INDEMNIFICATION AGREEMENT

I understand that the use of the dog park (“the Park”) means that I am taking certain risks of injury or damage to myself, my dogs, my property, and to others.  I recognize that injuries and damage, including serious injury and damage and death, may result when dogs are present, even if they appear to be supervised and controlled.  I hereby assume these risks to and for myself, my dogs and my property.  I agree to inspect the Park and persons and dogs using the Park when I arrive and to continue to stay vigilant.  I agree that it is my sole responsibility to determine whether the Park itself and any particular situation involving other persons and dogs are safe for my dogs, my property and me.

In exchange for the privilege to use the Park in accordance with the rules, I hereby release and discharge the Dog Park of Rarity Bay, Inc. and Rarity Bay Community Association, Inc., and their boards, officers, directors, members, employees, volunteers and agents from any and all liability, claims, demands, causes of action, loss, damage or injury to person or property, including from any death or serious injury, that may result from any incident, action or inaction while I or my guests or my dogs are on the Park premises or while attending any event sponsored by the Dog Park of Rarity Bay, Inc.

I also agree to be responsible for myself, my guests and my dogs and for any liability, loss, damage or injury caused by me, my guests and/or my dogs and to hold harmless and indemnify the Dog Park of Rarity Bay, Inc. and Rarity Bay Community Association, Inc. and their boards, officers, directors, members, employees, volunteers and agents from any and all liability, claims, demands, causes of action, including for attorneys fees and expenses, loss, damage or injury to any person or property, including from any death or serious injury, that may result from any incident, action or inaction while I or my guests or my dogs are on the Park premises or while attending any event sponsored by the Dog Park of Rarity Bay, Inc.

I have the legal capacity to sign this Agreement, including the Assumption of Risk, Release, Waiver and Indemnification Agreement. This Agreement shall be binding upon my heirs, beneficiaries, next of kin, personal representative or executor and assignees

This is a release of liability and a waiver and indemnification agreement. Do not sign if you do not understand or do not agree with its terms.

I HAVE CAREFULLY READ THIS AGREEMENT, INCLUDING THE ASSUMPTION OF RISK, RELEASE, WAIVER AND INDEMNIFICATION AGREEMENT, AND UNDERSTAND IT AND FULLY AGREE WITH ITS TERMS.

RULES AND REGULATIONS

DOG PARK OF RARITY BAY, INC. (“DPRB”)

PARK RULES


Park Hours of Operation are Dawn to Dusk.

All persons using the Park assume all risks of injury to person, dogs or property.  All persons using the Park are solely responsible for all injury or damage to other persons, dogs or property caused by them, their guests or their dogs.  DPRB assumes no responsibility.

  1. The use of the Park is limited to members of DPRB. Members may have persons without dogs accompany them into the Park.  Members may permit their adult “dog sitters” to use the Park with the members’ dogs, but the members remain responsible for the actions of their dog sitters and dogs.

  2. Temporary adult guests of members of DPRB who do not reside in Rarity Bay may use the Park upon filing the necessary Guest application and rabies immunization record and approval of the DPRB Board. A member of DPRB must accompany guests.

  3. A member may take a dog belonging to a Rarity Bay resident who is not a member of DPRB into the Park only if the member is caring temporarily for the dog in the absence of the nonmember resident and only if a Guest Application is completed, a rabies immunization record is provided and upon approval of the Board.

  4. No children under age 12 may be inside the Park. An adult must accompany and constantly supervise all minors under age 18 while inside the Park.

  5. All dogs must have current immunization records on file with DPRB.

  6. Keep clear of the entrance gates when another dog arrives or exits or is in the wash-off area.

  7. Ensure the gates are closed at all times. Do not share the gate code with nonmembers.

  8. Dogs with a history of or exhibiting biting or aggression are not allowed in the Park.

  9. Sick dogs and dogs in heat are not allowed in the Park.

  10. Dogs must be supervised and under control at all times.

  11. Only dogs weighing 30 lb. or more may be in the large dog area. Only dogs weighing less than 30 lb. may be in the small dog area.

  12. Dog feces must be promptly and properly disposed of in bags.  If a receptacle is made available for the Park, bags must be tied off and placed in the designated receptacle.

  13. No food (for people or for dogs), bones, or glass containers are allowed in the Park. Beverages are allowed.

  14. Water bowls must remain on the gravel area provided.

  15. Do not allow your dog to dig in the Park. Fill in any holes.

  16. Only tennis balls, Frisbees and hard rubber balls are allowed in the Park for the dogs.

  17. No strollers, bicycles, tricycles, wagons, similar devices or children’s toys are allowed in the Park.  Wheel chairs, scooters and walkers used by persons with physical limitations are allowed.

  18. Ask permission before approaching another person’s dog.

  19. If your dog inflicts an injury, give your name and telephone number to the victim.

    Infraction of these rules may be cause for membership termination.
